This review examines IC Markets (EU) Ltd specifically as a deposit and custody counterparty — that is, the risks associated with placing client capital at this broker. It is not a review of X45 trading performance, which is addressed separately in the X45 Institutional Due Diligence Pack (Ref: HAL-DD-004).
The three most important conclusions for an investor to understand before funding:
The relevant entity for the HavenAlgo proposition is IC Markets (EU) Ltd — not the broader IC Markets Global group. This distinction is important for regulatory protection purposes.
| Registered Name | IC Markets (EU) Ltd |
| Jurisdiction | Cyprus (Limassol) |
| Cyprus Company No. | HE 356877 |
| CySEC Licence No. | 362/18 |
| Licence Date | 25 June 2018 |
| Regulator | Cyprus Securities and Exchange Commission (CySEC) |
| Authorised Services | Reception/transmission of orders; Execution of orders; Dealing on own account |
| Licence Status (Aug 2026) | Active — confirmed on CySEC official register |
Investors should confirm current licence status independently at CySEC's official investment firm register (cysec.gov.cy) before funding, as authorisation status can change. The above was confirmed at the date of this document.
IC Markets EU is an MiFID II-compliant investment firm operating within the European regulatory framework. This is materially different from dealing with an unregulated offshore broker. All EU client-money rules, best-execution obligations, and reporting requirements apply to this entity.
IC Markets' current Terms and Conditions (June 2026) explicitly provide that client money is held in segregated accounts, separate from IC Markets' own operating funds. Client money is treated as belonging to clients and may not be used by IC Markets for its own purposes or to settle one client's obligations using another client's money.
This is a fundamental structural protection. Capital deposited by an investor does not become IC Markets' own money — it remains client money, held separately in compliance with CySEC client-money rules.
Client money is held in an omnibus segregated account — not an individually ring-fenced account in each client's name. IC Markets' own terms acknowledge this explicitly:
An investor's claim in an insolvency scenario is therefore against the relevant segregated client-money pool — not a specific named account. This is standard institutional client-money architecture, but it is important that investors understand it correctly.
Do not tell investors: "Your £1m sits in a bank account individually ring-fenced in your name."
The accurate statement is: "Your trading account is individually registered to you at IC Markets. Client money is held within segregated client-money arrangements that are separate from IC Markets' own operating funds, but are held on an omnibus basis across all clients."
IC Markets' terms confirm that client money may be deposited with third-party banks or financial institutions, including institutions located outside Cyprus. The terms explicitly acknowledge that if such a third-party institution fails, clients may be exposed to the risk that insufficient money is recovered.
For a significant allocation, investors should ask IC Markets in writing:
IC Markets' current June 2026 terms include a provision permitting clients to notify IC Markets that they do not wish their money held with a counterparty outside Cyprus. For a large allocation, exercising this right should be actively considered.
If IC Markets (EU) Ltd were to become insolvent, the recovery process would work through the following hierarchy. Segregation is the primary protection; statutory compensation is a limited backstop only.
| Layer | Mechanism | Assessment |
|---|---|---|
| 1 | Client-money segregation Client money is held separately and should not form part of the general insolvency estate |
Strong in principle — but recovery speed and completeness depends on insolvency proceedings and third-party bank positions |
| 2 | Recovery from third-party custodians Segregated pools must be recovered from the banks/institutions holding them |
Dependent on those institutions' own solvency and the applicable legal regime |
| 3 | Cyprus/EU regulatory and insolvency processes CySEC and court-supervised insolvency administration |
Can be lengthy; investors should not assume rapid access to funds during proceedings |
| 4 | Investor Compensation Fund (ICF) Statutory compensation for eligible investors |
Maximum €20,000. Professional clients are excluded entirely. |
Segregation substantially reduces broker insolvency risk — but does not eliminate all recovery risk. It is not the same as a government-backed deposit guarantee. For a £1m allocation, the distinction between "segregated" and "guaranteed" is material.
Cyprus' Investor Compensation Fund (ICF) provides compensation of the lower of:
The ICF is not a deposit insurance scheme covering the full value of client funds. For a professional-level allocation, the following table illustrates the disparity:
| Account Balance | ICF Maximum Compensation | Coverage Ratio |
|---|---|---|
| €20,000 | Up to €18,000 | ~90% |
| €100,000 | €20,000 maximum | 20% |
| £250,000 | €20,000 maximum | <10% |
| £500,000 | €20,000 maximum | <5% |
| £1,000,000 | €20,000 maximum | <2% |
IC Markets' current professional client documentation, and CySEC's own rules, explicitly state that professional clients are not eligible for ICF compensation. A sophisticated investor qualifying as — or choosing to be classified as — a Professional Client would have no ICF backstop, regardless of account size.
If an investor is classified as a Professional Client at IC Markets:
The decision to seek or accept Professional Client status should be made after independent legal and financial advice, with full understanding of the ICF exclusion.
For large allocators, the practical implication is: segregation is the protection that matters. The ICF is not designed for institutional-scale deposits. This must be communicated clearly to investors, not obscured.
IC Markets' current Terms and Conditions confirm that clients may withdraw funds not required for margin or other obligations. The investor retains full withdrawal authority at all times, and HavenAlgo has no withdrawal permissions on client accounts.
Withdrawals are subject to IC Markets' standard procedures, which include:
For a large withdrawal — particularly £100,000 or more — enhanced AML and source-of-wealth verification is a reasonable expectation. This can extend processing timelines beyond normal retail withdrawal speeds.
HavenAlgo materials should not represent withdrawal as "instant" or guarantee a specific settlement period. The legally accurate and appropriate statement is:
"The client retains withdrawal authority at all times and may withdraw funds not required for margin purposes. Withdrawals are subject to IC Markets' standard verification, AML, sanctions, fraud-prevention, and processing procedures. Processing timelines may vary, particularly for large withdrawals subject to enhanced checks."
In the event of regulatory investigation, court order, account freeze, or systemic market disruption, access to funds could be restricted temporarily regardless of the segregation status. This is a risk to be acknowledged rather than dismissed — it does not mean the money is lost, but it may not be immediately accessible.
IC Markets' June 2026 Terms and Conditions state explicitly:
IC Markets is an ECN/Raw Spread broker that routes orders to underlying liquidity providers — but the client's contractual relationship is with IC Markets itself, not with the underlying liquidity pools. IC Markets may hedge or otherwise manage the exposure through third-party liquidity providers, but it remains the principal counterparty.
This means there is direct counterparty exposure to IC Markets on all open positions. This is standard market structure for regulated CFD/FX brokers and does not make IC Markets unusual, but investors committing significant capital should understand that they are not transacting directly with a centralised exchange.
For the X45 strategy specifically: the entire historical performance record was generated within this specific execution environment. IC Markets' spreads, liquidity, and execution conditions are therefore integral to the observed results.
IC Markets (EU) Ltd has an administrative sanction history that must be disclosed to institutional investors. Failure to disclose this material information would undermine the credibility of the HavenAlgo due diligence process.
| Date | Matter | Sanction | Status |
|---|---|---|---|
| July 2024 | Leverage circumvention. IC Markets EU participated in arrangements that circumvented EU/CySEC retail CFD initial-margin and leverage protections. Retail clients were facilitated to access leverage of up to 1:1,000 through a third-country group entity, when the applicable EU retail maximum was 1:30. | €200,000 | Judicial review filed (pending at date of this document) |
| 2024 | Best-execution failure. CySEC found that IC Markets had failed to take sufficient steps to obtain the best possible result for clients when executing orders, with particular reference to price and size. | €50,000 | Judicial review filed (pending at date of this document) |
These sanctions are classified as material regulatory history — disclosed, rather than evidence of insolvency risk or imminent regulatory failure. IC Markets remains authorised by CySEC as of the date of this document.
However, the nature of the leverage sanction is directly relevant to the HavenAlgo deployment:
IC Markets' June 2026 Terms and Conditions define "Abusive Trading" broadly. Relevant provisions include prohibitions on:
The X45 Expert Adviser is an automated trading system. Before deploying a significant allocation through any new client account, HavenAlgo recommends that clients obtain written confirmation from IC Markets EU that:
£1m is too significant an amount to rely on an implied or assumed interpretation of broker terms. Written confirmation is a condition precedent to large-scale deployment.
The historical performance record was generated on an account where this authorisation is understood to have been in place. New client accounts must independently secure the same permissions.
| Risk Category | Rating | Assessment |
|---|---|---|
| Regulatory legitimacy | Low / Moderate | CySEC-authorised; active licence confirmed; MiFID II-compliant EU entity |
| Client-money segregation | Strong | Explicitly provided for in current T&Cs; omnibus structure — standard for regulated brokers |
| Broker insolvency risk | Moderate | Segregation substantially reduces risk but does not eliminate all recovery uncertainty |
| Third-party custodian risk | Moderate | Client money may be held outside Cyprus; identity of custodian banks not publicly disclosed |
| ICF statutory compensation | Weak for large deposits | €20,000 maximum; professional clients entirely excluded; not designed for institutional scale |
| Withdrawal risk | Moderate | Client controls withdrawal authority; AML/KYC checks can delay large withdrawals |
| Regulatory history | Moderate | Two 2024 CySEC sanctions (€200k leverage / €50k best-execution); IC Markets remains authorised |
| EA/automated trading compliance | Moderate — Action Required | Terms include automated-trading provisions; written broker confirmation required before deployment |
| HavenAlgo custody risk | Low | Non-custodial structure — HavenAlgo never holds or controls client capital |
| Trading / strategy risk | High | The primary capital risk is X45 trading losses — not IC Markets' financial stability |
| Overall broker suitability | Credible with Conditions | Suitable institutional-grade execution venue subject to the conditions in Section 11 |
For a six or seven-figure allocation, the following steps are recommended as conditions precedent to funding. They are divided into broker-level verification (for the investor to conduct with IC Markets) and HavenAlgo/EA verification.
| Scenario | What Happens? | Investor Risk | Risk Level |
|---|---|---|---|
| X45 loses money | IC Markets functions normally; account balance falls | Trading losses — potentially substantial | High |
| HavenAlgo ceases to operate | EA stops; broker account remains investor's — investor can withdraw or trade manually | Low custody risk; strategy stops | Low |
| IC Markets operational outage | Trading and/or withdrawals temporarily disrupted | Temporary — operational risk | Low–Moderate |
| IC Markets becomes insolvent | Client-money segregation process begins; insolvency administrator appointed | Recovery possible but uncertain; ICF covers €20k maximum (nil for professional clients) | Moderate |
| Third-party client-money bank fails | Recovery of client funds from that institution may be delayed or impaired | Counterparty risk — magnitude depends on which institution and jurisdiction | Moderate |
| Large withdrawal AML review | IC Markets places withdrawal on hold pending source-of-wealth / AML checks | Temporary delay — funds are not lost, but access is restricted | Moderate |
| Extreme FX market event | Strategy experiences severe drawdown; margin liquidation possible in extreme cases | Severe capital loss risk | High |
| Regulatory intervention on account | Regulator requires account freeze or trading cessation | Access temporarily restricted; capital not permanently lost unless court order | Moderate |
| Cyberattack / platform breach | Trading or account access disrupted; potential for unauthorised activity | Operational risk; covered by broker security obligations but not guaranteed | Moderate |
The HavenAlgo deployment structure provides a genuine and material structural advantage compared with conventional fund or managed-account structures. This should be explained clearly — not overstated, but not understated.
In a conventional fund structure:
Risks include custody risk, manager fraud risk, withdrawal gates, NAV manipulation risk, and fund administrator risk.
In the HavenAlgo structure:
The investor:
This is a meaningful structural protection. However, it protects against HavenAlgo custody risk — it does not protect against trading losses, broker failure, execution risk, or the other risks identified in this document.
Based on this broker risk review, the following language changes are required across HavenAlgo marketing, onboarding, and DD materials. These changes improve accuracy and reduce regulatory exposure.
"Capital protected"
Replace with: "Non-custodial structure. Client capital held at IC Markets in the investor's own account. HavenAlgo does not hold or control client funds at any point. This structure reduces manager/custody risk but does not protect against trading losses, broker failure, or market risk."
"Withdraw anytime (T+1 settlement)"
Replace with: "The client retains withdrawal authority at all times, subject to IC Markets' applicable margin requirements, verification, AML, sanctions, fraud-prevention, and withdrawal processing procedures."
"IC Markets is a Tier-1 broker"
Replace with: "IC Markets (EU) Ltd is a CySEC-regulated investment firm (Licence 362/18), operating since June 2018, subject to MiFID II client-money and execution standards."
"Your account is not part of the bankruptcy estate" / "Risk of bankruptcy is low" / "IC Markets can't prevent you withdrawing"
Replace with: "Client money is held in segregated arrangements separate from IC Markets' operating funds, substantially reducing broker insolvency risk. However, segregation is not equivalent to a government-backed guarantee. For a large allocation, the €20,000 ICF statutory compensation ceiling and the professional-client ICF exclusion should be understood before funding."
"Protected up to €20,000" [without professional client exclusion disclosure]
Add: "Note: ICF protection is available to eligible non-professional (retail) investors only. Investors classified as Professional Clients are not eligible for ICF compensation. The ICF maximum is €20,000 per investor — it is not designed as a guarantee of large professional-scale deposits."
[No mention of regulatory history in current materials]
Add to DD pack: "Regulatory History — Disclosed: In 2024, CySEC imposed administrative fines of €200,000 (leverage circumvention arrangements) and €50,000 (best-execution obligations) on IC Markets (EU) Ltd. Both matters are subject to judicial review proceedings. IC Markets remains currently authorised by CySEC. HavenAlgo discloses this history in full as part of its commitment to transparent investor due diligence."
The following provisions should be reflected in the investor-facing Licence Agreement and, where applicable, in the Commercialisation Agreement with Andro. They address broker risk in a legally appropriate and commercially protective way.
The Client is solely responsible for selecting and maintaining their own broker account and for verifying that: (a) the broker is appropriately authorised and regulated in the Client's jurisdiction; (b) the broker's client-money protections, compensation arrangements, and withdrawal procedures are adequate for the Client's investment objectives; and (c) automated EA trading is expressly permitted on the Client's account under the broker's current terms. HavenAlgo makes no representation as to the financial stability, regulatory status, or solvency of any broker, including IC Markets (EU) Ltd.
The Client retains full withdrawal authority at all times and HavenAlgo does not hold, control, or have any access to Client funds. HavenAlgo does not guarantee, represent, or warrant that the Client's broker will process any specific withdrawal within any particular timeframe, and acknowledges that withdrawals may be subject to broker AML, verification, sanctions, and processing procedures beyond HavenAlgo's control.
Nothing in this Agreement constitutes a guarantee, warranty, or representation that: (a) the Client's capital is protected against trading losses; (b) the Client's broker is or will remain solvent; (c) client money held at any broker is fully insured or compensated by any government or compensation scheme. The Client acknowledges that the statutory Investor Compensation Fund (where applicable) provides a maximum of €20,000 per investor and that Professional Client status excludes ICF eligibility entirely.
Prior to deploying the Licensed Software on any live account, the Client shall obtain written confirmation from their chosen broker that: (a) automated EA trading is permitted on the specific account; (b) the EA's operation does not breach the broker's terms regarding abusive trading or automated access; and (c) the required MT5/API/VPS access is available. HavenAlgo accepts no liability for account restriction, suspension, or closure arising from a broker's determination that EA trading is in breach of the broker's terms.
HavenAlgo recommends, as a matter of prudent practice, that Clients commence with a reduced allocation during an initial validation period before scaling to their intended full allocation. This recommendation is advisory only and the Client bears sole responsibility for their capital allocation decisions.
IC Markets (EU) Ltd is a credible, CySEC-regulated execution venue with meaningful client-money segregation protections. For the purposes of the HavenAlgo X45 deployment, it represents an appropriate institutional-grade broker environment — subject to the conditions and disclosures set out in this document.
The statement HavenAlgo should be comfortable making to institutional investors is:
The statement HavenAlgo should not make is:
Honest, accurate disclosure of these risks — alongside the genuine structural advantages of the non-custodial HavenAlgo model — is both the legally appropriate and commercially strongest approach. Serious investors diligence the broker as well as the strategy. A DD pack that addresses broker risk with institutional rigour materially increases confidence and credibility.
